Federal Court Mandates Release of Abrego Garcia from ICE Detention
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The situation originates in a erroneous removal to El Salvador in March, which the government later acknowledged was an mistake. After his return to the United States to face human smuggling charges, he was detained in federal detention.
In her order, the judge pointed out that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
