The federal appeals court has maintained a prohibition on deploying state troops in the Oregon city, after a latest legal decision.

Judicial Panel Concurs to Rehear Case

The ninth circuit court of appeals decided on this week that it would reexamine the legal dispute concerning the executive power with an larger group of eleven justices. The judicial body also overturned a previous ruling from a three-judge panel that had supported the federal government.

Legal Saga Over Troop Deployment

This order represents the most recent turn in a protracted legal battle over whether the former president has the legal right and valid reason to deploy state military units in Portland. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was initiated in due to months of protests.

Differing Viewpoints

The administration has argued that government employees at the ICE facility in south Portland were under attack, while local authorities assert that local officers have control of the situation.

In defiance of characterizations of Portland as “war ravaged”, residents have been posting footage of lush hiking trails and a vibrant culinary culture, and organizing events such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The Tuesday ruling came after a US district judge in the city enacted two legal injunctions this month – one preventing the federal control of the state troops, and another stopping the deployment of any military personnel in the state, after attempts to evade the initial injunction by mobilizing out-of-state forces.

On Monday, the ninth circuit panel had temporarily suspended the initial decision – allowing control of 200 Oregon national guard – but the subsequent injunction stayed effective, blocking the actual deployment of the troops.

En Banc Review

The latest ruling means the matter will be heard by the full court – with both rulings under consideration simultaneously – by a panel of eleven justices.

“This ruling shows that facts are important and that the judicial system are working to ensure government responsibility. The constitution limits the president’s power, and local populations cannot be treated as a testing site for expansive government power,” said the legal representative in a statement.

“The court is sending a definite signal: the executive leader cannot send the military into American urban areas without cause. We will continue protecting state legislation, principles, and autonomy as this legal proceeding moves forward and our legal battle continues in the courts.”
